Even where marketing is accurate, agents are monitored, and learners are suitable, risk still arises when third-party delivery or recruitment arrangements are unclear, undocumented or misaligned with scope.
Under the NVR Standards, RTOs must ensure that:
- Third-party arrangements are formally documented
- The scope of responsibility is clearly defined
- Students are informed when a third party is involved
- Oversight mechanisms are active and traceable
Third-party arrangements do not reduce accountability.
They increase governance responsibility.
Where delivery or recruitment is outsourced, regulatory responsibility remains with the RTO.
What the Standard Requires
RTOs must:
- Document third-party agreements in writing
- Clearly define roles and responsibilities
- Ensure activities align with scope of registration
- Inform learners when a third party is delivering training, assessment or recruitment services
- Actively monitor third-party compliance
Governance Standards (4.1 and 4.2) require leadership oversight of these arrangements.
The existence of a contract alone is not sufficient.
Monitoring and control must be demonstrable.
Where Operational Gaps Arise
Common weaknesses include:
- Outdated or generic agreements
- Agreements not aligned to current scope
- Recruitment-only arrangements undocumented
- Marketing not reflecting third-party delivery
- No structured monitoring schedule
- Monitoring activity occurring informally without evidence
- Scope changes not reflected in contracts
